1. Terms and conditions

By accessing or using the TowHero mobile application or related services (“Services”), you agree to be bound by these Terms of Service. Please read them carefully before using the app.

Acceptance and eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement to use TowHero. By creating an account or using the Services, you represent that you meet these requirements and accept these terms in full.

Description of services

TowHero connects car owners and towing companies through a mobile platform. We provide notification, payment, and dispute-resolution tools to facilitate towing transactions. We do not provide towing services ourselves; we are a technology intermediary.

User obligations and acceptable use

  • You will provide accurate account and vehicle information where required.
  • You will not use the Services for any illegal or fraudulent purpose.
  • You will not harass other users, towing companies, or TowHero staff.
  • You are responsible for maintaining the security of your account credentials.

Disclaimers and limitation of liability

The Services are provided “as is.” TowHero disclaims warranties to the extent permitted by law. Our liability for any claims arising from your use of the Services is limited to the amount you paid us in the twelve (12) months preceding the claim, or as otherwise required by applicable law. Replace and expand these provisions with your actual legal terms and have them reviewed by counsel before launch.

2. Return policy and process (if physical goods are sold)

TowHero is primarily a digital service. We do not currently sell physical goods through the app. In-app transactions relate to towing and storage services arranged between users and towing companies, not to the sale of products by TowHero.

If we offer physical goods in the future

If TowHero later sells or facilitates the sale of physical goods (e.g., merchandise, equipment), we will publish a return policy that covers at least the following:

  • Eligibility: Which items may be returned and any exclusions (e.g., perishable, custom, or hygiene-sensitive items).
  • Timeframe: The window in which returns must be requested (e.g., within 30 days of delivery).
  • Condition: Requirements for unused, unopened, or original packaging where applicable.
  • Process: How to initiate a return (e.g., in-app form, email), whether a return label is provided, and where to send the item.
  • Refunds: How and when refunds will be issued (e.g., original payment method, within 5–10 business days).

Until such a policy is published, no returns of physical goods apply. Replace this section with your actual return policy if you sell physical goods.

3. Refund and dispute policy

This policy applies to payments made through TowHero (e.g., tow and storage fees) and to disagreements between car owners and towing companies that involve the use of our platform.

When refunds may be available

  • Duplicate or erroneous charges processed through the app.
  • Services not rendered as agreed (e.g., tow not performed, wrong vehicle).
  • Amount charged in excess of the agreed or displayed price.
  • Other circumstances as determined by TowHero or as required by law.

How to request a refund

Submit a refund request through the in-app support or dispute flow, or contact us using the contact details on our website. Include your account information, transaction date, amount, and a short description of why you believe a refund is warranted. We will review and respond within a stated timeframe (e.g., 5–10 business days).

Disputes between users

If you disagree with a towing company (or, for towers, with a car owner) about a tow, storage, or payment, you may use TowHero’s in-app dispute tool to submit your case. We will review the information provided by both parties and may request additional documentation. Our role is to facilitate resolution; we do not guarantee any particular outcome. Final resolution may depend on the parties’ agreement or applicable law. Replace with your actual refund and dispute procedures and timelines.

4. Cancellation policy (if applicable)

This section applies if TowHero offers paid subscriptions, memberships, or other recurring or cancellable services (e.g., premium features for towing companies).

How to cancel

You may cancel a subscription or membership through your device’s app store settings (iOS or Android) or through the account or billing section within the TowHero app, if we offer in-app cancellation. Cancellation will take effect at the end of the current billing period unless otherwise stated.

Notice and refunds on cancellation

No advance notice is required to cancel, but we may require notice for certain plan types. Unless required by law or stated in your plan, fees already paid for the current period are generally non-refundable upon cancellation. Replace with your actual cancellation and refund rules.

If cancellation does not apply

If TowHero does not offer subscriptions or cancellable plans, this section may not apply. One-time in-app payments for towing or storage are governed by the Refund and dispute policy above, not by this cancellation policy.

6. Terms and conditions of any promotions

From time to time, TowHero may run promotions, discounts, referral programs, free trials, or other offers (“Promotions”). Participation in any Promotion is subject to these terms and to any additional terms stated for that specific Promotion.

General rules

  • Promotions are valid only for the period and in the manner described in the offer (e.g., first-time users, specific regions, or partner towing companies).
  • Only one promotion per user, account, device, or transaction may apply unless otherwise stated.
  • Promotions cannot be combined with other offers unless we explicitly allow it.
  • TowHero reserves the right to modify, suspend, or end any Promotion at any time without prior notice, to the extent permitted by law.

Referral and incentive programs

If we offer referral credits or similar incentives, the referring user and the referred user must each comply with the program rules. Credits or rewards may be subject to minimum activity, expiration, or other conditions. We may void or claw back credits if we detect abuse, fraud, or violation of these terms.

Specific promotion terms

For each Promotion, we may publish separate terms (e.g., in the app, on our website, or in marketing materials). In the event of a conflict between those terms and this section, the specific Promotion terms will govern for that Promotion. Replace this section with your actual promotion terms before running any offers.
